Welcome to Digitalcord Agency (“Digitalcord”, “we”, “us”, or “our”). These Terms & Conditions govern your access to and use of our website (https://digitalcord.agency/) and the professional digital marketing, SEO, PPC, social media, web development, content, branding, and email marketing services provided by our agency.

By accessing our website, making an inquiry, or engaging our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or services.

1. Services Offered

Digitalcord provides full-service digital marketing solutions tailored for businesses, including but not limited to AI SEO, Google Ads/PPC management, Meta & Social Media Marketing, Web Design & Development, Content Marketing, Branding & Creative Services, and Email Marketing Automations. The specific scope of work, deliverables, timelines, and budgets for any project will be agreed upon separately in a formal Service Proposal or Agreement.

2. User Conduct & Website Usage

By visiting and using our website, you agree that you will not:

  • Use the website for any unlawful purpose or in violation of Indian local, national, or international laws.

  • Attempt to compromise the security, integrity, or functionality of our website servers or underlying infrastructure.

  • Copy, scrape, reproduce, or redistribute any text, imagery, branding, or source code from digitalcord.agency without prior written consent.

3. Client Responsibilities & Materials

For service delivery, clients are responsible for providing timely access to necessary assets, including account permissions, website credentials, branding guidelines, content approvals, and media files. Digitalcord is not responsible for campaign delays or sub-optimal performance resulting from delayed client approvals or incomplete information.

4. Intellectual Property Rights

All proprietary marketing strategies, custom software code, original graphic designs, and unique content developed by Digitalcord prior to full project payment remain our intellectual property. Upon full payment of all contractual fees, full ownership and rights of custom website builds, creative graphics, and campaign deliverables transfer to the client, while Digitalcord retains the non-exclusive right to display completed works in its agency portfolio and case studies.

5. Payment Terms & Billing

All financial arrangements are strictly outlined in individual client agreements:

  • Retainers & Services: Monthly ongoing services (such as SEO, PPC, and Social Media Management) are payable in advance on a recurring schedule.

  • Project-Based Work: Web development and branding projects typically require an initial deposit prior to project commencement, with balance payments tied to milestone completions.

  • Ad Spend: Media ad spend budgets for Google Ads, Bing Ads, Meta Ads, etc., are paid directly to the respective ad platforms by the client and are separate from Digitalcord’s agency management fees.

6. Performance Disclaimer & Warranties

Digitalcord strives to deliver maximum Return on Investment (ROI) and data-backed digital growth using industry best practices. However, digital marketing outcomes depend on third-party platform algorithms (Google, Bing, Meta), market conditions, and competitor activity. Consequently, Digitalcord does not guarantee specific organic ranking positions, exact ad conversion counts, or immediate revenue figures.

7. Limitation of Liability

To the maximum extent permitted by applicable law in India, Digitalcord Agency shall not be liable for any indirect, incidental, consequential, or special damages, including lost profits, business interruption, or data loss arising out of or in connection with our services or website usage. Our total liability for any claim shall not exceed the amount actually paid by the client to Digitalcord for the specific service in question during the preceding three (3) months.

8. Confidentiality

Both Digitalcord and the Client agree to treat all business data, technical access credentials, financial details, and trade secrets shared during the engagement as strictly confidential. Neither party will disclose sensitive confidential information to third parties without prior written authorization.

9. Termination & Cancellation

Either party may terminate a service contract in accordance with the cancellation terms specified in their individual Agreement (typically requiring 30 days’ written notice for monthly retainers). Upon termination, all outstanding payments for work completed up to the termination date must be settled immediately.

10. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any legal disputes, claims, or proceedings arising under or in connection with these terms shall fall under the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.

11. Updates to Terms

We reserve the right to modify or update these Terms & Conditions at any time to reflect operational, legal, or regulatory changes. Updated versions will be posted directly on this page with an updated effective date. Continued use of our website or services constitutes acceptance of the modified terms.
